Credit And Debit Card Surcharges To Be Banned from January 2018

From 13th January 2018, there will be a prohibition on the charging of fees when taking payments for certain transactions. Please find attached a guide to the regulations

1.       Applies to contract for goods and services between Consumers and Businesses NOT between business and business
2.       Bans surcharges for use of credit/debit/charge cards, similar methods e.g. mobile phone  and electronic payments for service e.g Paypal
3.       Permits restrictions on use  e.g no credit/debit card transactions under 10 p— If you choose to place a restriction on use you MUST display this
4.       Permits surcharges for other payment  such as cheques e.g 10 p  processing on cheques  but only the cost charged  to the trader for the processing— If you choose to place a restriction on use you MUST display this
5.       Permits a booking fee to be charged —ONLY if it applies to ALL payment methods accepted
6.       Permits a delivery fee to be charged —ONLY if it applies to ALL payment methods
